Under the Fifth Amendment of the U.S. Constitution provides, the defendant enjoys a right of not having to provide self-incriminating testimony. At the stage of a trial when the jury determines guilt or innocence, a jury cannot infer the defendant's failure to appear or answer as an admission of guilt.
